Terms of Use
Using PhenScope
PhenScope is a professional inspection and reporting application operated by Christopher Wilson trading as PhenKel. PhenScope provides tools for recording and organising inspection information and producing reports.
PhenScope assists the user. It does not replace appropriate professional knowledge, competence, inspection procedures or judgement.
User responsibility
Users are responsible for the information entered into PhenScope and for determining whether that information is accurate and suitable for its intended purpose. Users remain responsible for carrying out inspections appropriately, checking measurements and calculations, verifying observations and photographs, determining findings and recommendations and checking reports before issue.
Reports
PhenScope can generate PDF reports using information supplied by the user. Generation of a PhenScope report does not constitute inspection, certification or approval by PhenKel. Professional opinions, conclusions, findings and recommendations remain the responsibility of the person or organisation issuing the report.
Lite and Pro
PhenScope Lite provides the core inspection workflow with standard PhenScope report branding. PhenScope Pro provides additional eligible functionality including Report Studio customisation and company branding.
Subscriptions
PhenScope Pro is intended to be offered as a monthly auto-renewable subscription through Apple's App Store. The price and subscription information displayed by Apple at the point of purchase apply to that transaction. Subscriptions can be managed or cancelled through the user's Apple subscription settings.
Nothing in these Terms is intended to restrict statutory consumer rights that cannot lawfully be excluded.
Data and backups
PhenScope primarily stores inspection information locally. Users are responsible for maintaining appropriate backups of important information. PhenKel cannot guarantee recovery of locally stored information following device loss, damage, deletion, software failure or removal of the application.
Acceptable use
PhenScope must not knowingly be used for unlawful purposes, to deliberately create fraudulent or misleading inspection records, to infringe another person's rights, or to interfere with the security or operation of PhenScope.
Availability and updates
PhenKel may release updates to improve reliability, compatibility, security or functionality. Uninterrupted or error-free operation cannot be guaranteed, including where PhenScope depends on mobile operating systems or third-party platform services.
Professional reliance
The suitability of an inspection methodology, test, measurement, calculation, conclusion or recommendation depends upon the circumstances of the work and the competence of the person undertaking it. Supplying PhenScope does not itself constitute engineering, surveying, structural, health and safety or other professional certification by PhenKel.
Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful. Subject to applicable rights, PhenKel is not responsible for professional decisions made by users, inaccurate information entered into PhenScope, or reports issued without appropriate user review.

Professional Use Disclaimer
PhenScope is a digital inspection and reporting tool used to assist with the recording, organisation and presentation of inspection information. PhenScope and PhenKel do not independently inspect, verify, certify or approve the condition, safety or compliance of any asset, structure, installation or workmanship described within a report.
Responsibility for the accuracy of the information recorded, the inspection methodology used, and any findings, conclusions or recommendations contained within a report remains with the person or organisation carrying out and issuing the inspection.
